Terms of use

These terms are an agreement between you and FriendMachine Labs, LLC, a Michigan limited liability company doing business as CarveKin ("CarveKin", "we"). By using carvekin.com or buying a pattern, you agree to them. Our privacy policy and refund policy are part of these terms.

1. Who can use CarveKin

You must be at least 18 to buy patterns or create an account. Younger people may use CarveKin with a parent or guardian who agrees to these terms. CarveKin is not directed to children under 13.

2. Your photos

You keep ownership of the photos you upload. You give us permission to store, process, and send your photo to our service providers only as needed to make, check, and deliver your pattern. You confirm that you took the photo or have permission to use it, and that using it doesn't violate anyone's rights.

Don't upload images that are illegal, sexual, hateful, or harassing, or that show someone who hasn't agreed to it in a way they would object to. We may refuse or delete a job that breaks these rules; if we do, we'll refund any credit it used.

3. Your patterns

We give you all rights we have in the patterns made for you. You may print them, carve them, share photos of your carvings, and give them to friends and family. You may not resell our service by selling patterns in bulk. If your photo shows a character, brand, or artwork owned by someone else, their rights still apply to your pattern.

3a. Photos of your carving

If you send us a photo of your carved pumpkin and allow us to feature it, you give us permission to show it, with the name you provide, on carvekin.com and our social media. Ask us any time and we'll stop using it. Please only send photos you took, and avoid photos of people.

4. Prices, credits, and payment

Prices are shown before you pay: currently $4.99 for one credit and $9.99 for the five-credit Family pack, in US dollars. Stripe processes payment and shows any sales tax before you confirm.
One credit makes one approved design at the difficulty you choose. A credit is used only when your pattern passes our checks and its files are ready. You can then get the same design at other offered sizes at no charge; each size is checked separately, and some designs can't be made very small.
Credits don't expire, have no cash value, and can't be transferred or resold. The Family pack requires an account so your remaining credits stay recoverable.
We may change prices for future purchases. Credits you already bought keep working.
Promotion codes have no cash value, apply one per purchase, can't be combined, and may expire or have limits shown when you use them. We may cancel a code that is shared or used in ways it wasn't meant for. Free gift codes are limited to one per person and need a verified email.

5. Refunds

If we can't make your pattern, your credit is not used, and you can ask for a refund. Our refund policy explains when and how we refund purchases.

6. What our checks mean

We check each pattern's shapes at the printed size so kept pieces stay attached and cut details aren't too narrow. These are checks on the drawing, not on a real pumpkin. Pumpkins vary, and we can't promise how one will carve, how long it will last, or how closely a pattern will resemble your photo.

7. Carving safety

Carving uses sharp tools. Use tools made for pumpkin carving, cut away from your hands, and supervise children closely. Use battery lights rather than open flames where you can, and never leave a candle unattended. You are responsible for how you carve and display your pumpkin.

8. Accounts and access

Keep access to your email secure; sign-in codes and recovery links are sent there. You can sign out of every device from your account page. We may suspend access that is used to abuse the service, attack it, or evade its limits.

9. Deleting your patterns

You can delete a pattern and its files at any time. Deletion can't erase copies you already downloaded or shared. We keep payment records as the law requires.

10. The service is provided as is

We work hard to keep CarveKin available and your files correct, but the service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties, including fitness for a particular purpose. Pattern creation may pause when demand is high or a provider is unavailable.

11. Limits on liability

To the extent the law allows, CarveKin is not liable for indirect or consequential damages, or for injury or property damage from carving or displaying a pumpkin. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $20. Some places don't allow these limits, so they may not apply to you.

12. Disputes

Please contact us first; most problems are solved by a quick email or refund. These terms are governed by Michigan law, without regard to conflict-of-laws rules. Either of us may bring a claim in small-claims court. Otherwise, claims go to the state or federal courts in Michigan. Nothing here takes away rights you have under the consumer laws where you live.

13. Changes

We may update these terms. We'll change the date above, and the terms in effect when you buy apply to that purchase.
